Rent control in Paris: check before you sign

In Paris, the rent of most leases is capped by a maximum reference rent (loyer de référence majoré) set by decree, neighbourhood by neighbourhood. Yet many listings exceed it, counting on tenants who do not know the rules, starting with newcomers and internationals. Checking takes five minutes and can save hundreds of euros per month.

How Paris rent control works

For each neighbourhood and each type of home (number of rooms, construction period, furnished or not), a prefectural decree sets three values: the reference rent, the maximum reference rent (+20%) and the minimum reference rent (-30%). The rent per square metre in your lease cannot exceed the maximum reference.

The scheme applies to standard residential leases, to furnished leases (with specific, higher references) and to mobility leases. The lease must state the applicable maximum reference rent.

  • 1. Note the living area, the number of rooms, the approximate construction year, furnished or not, and the exact address.
  • 2. Look up the official reference rents for Paris (City of Paris and regional prefecture publish a simulator). Our French-language rent checker compares your rent to the official grid of the 80 Paris neighbourhoods.
  • 3. Compute: rent excluding charges ÷ living area = rent per m². Compare it to the maximum reference of the neighbourhood.
  • 4. Above the cap? Check whether a rent supplement (complément de loyer) is written into the lease, and whether it is genuinely justified.

The rent supplement: the exception used as an excuse

A landlord may exceed the maximum reference only through an explicit rent supplement in the lease, justified by comfort or location features that are exceptional compared with similar homes in the neighbourhood: a large terrace, a remarkable view, rare equipment. An ordinary balcony, "lovely light" or a standard renovation do not qualify.

The supplement can be contested within 3 months of signing the lease, before the departmental conciliation commission: it is free, and the burden of proving the exceptional feature lies with the landlord.

Rent above the cap: your concrete remedies

Note: rent control also exists elsewhere in Île-de-France, notably in the Est Ensemble and Plaine Commune areas, just north and east of Paris. That five-minute check is worth doing beyond the ring road too.

  • Before signing: negotiate by quoting the maximum reference rent (a legal argument changes the balance of power), or walk away.
  • After signing: an action to reduce the rent, first amicably (registered letter), then before the departmental conciliation commission, free of charge and with no lawyer required.
  • Report the breach to the City of Paris: the landlord risks an administrative fine of up to €5,000 (€15,000 for a legal entity such as a company).

Frequently asked questions

Does rent control apply to furnished homes and mobility leases?

Yes. Furnished homes have their own, slightly higher reference rents, and the mobility lease is subject to the same caps as a standard furnished lease.

What can I do if my rent exceeds the maximum reference?

Start with an amicable request by registered letter, then bring the case to the departmental conciliation commission (free). In parallel, the breach can be reported to the City of Paris, which can fine the landlord.

Is a rent supplement legal?

Yes, but only if it is written into the lease and justified by genuinely exceptional features compared with similar homes in the neighbourhood. It can be contested at the start of the lease before the conciliation commission.

Does rent control exist outside Paris?

Yes, notably in the Est Ensemble and Plaine Commune areas in Seine-Saint-Denis. Each area has its own reference rents: check the local simulator.
